Welcome to Win Mode
These Terms of Service (“Terms”) are a legal agreement between you and ArchitecturePLUS SRL (“we,” “us,” “our,” or “Company”) governing your use of the Win Mode mobile application (the “App”), website, and related services (collectively, the “Services”).

PLEASE READ THESE TERMS CAREFULLY BEFORE USING WIN MODE. BY ACCESSING OR USING THE APP, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP.
1. Acceptance of Terms
1.1 Agreement to Terms
By creating an account, accessing, or using Win Mode, you acknowledge that:
- You have read and understood these Terms
- You agree to be bound by these Terms
- You have read and agree to our Privacy Policy (available at https://winmode.io/privacy-policy)
- You are at least 9 years old (or the minimum age required in your jurisdiction)
1.2 Parental Consent
If you are under 18 years old (or the age of majority in your jurisdiction), you represent that:
- Your parent or legal guardian has reviewed and agreed to these Terms on your behalf
- You have permission from your parent or legal guardian to use the App
Parents or guardians who permit minors to use the App agree to be bound by these Terms and are responsible for the minor’s activities.
1.3 Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Posting the updated Terms in the App
- Sending an in-app notification or email
- Updating the “Last Updated” date
Your continued use of the App after changes constitutes acceptance of the modified Terms. If you do not agree with the changes, you must stop using the App and cancel your subscription.

Certain features may be subject to additional terms and conditions, which will be presented to you at the time you access those features. Those additional terms are incorporated into these Terms by reference.
2. Description of Service
2.1 What Win Mode Provides
Win Mode is an AI-powered habit coaching application that helps users:
- Build and track habits
- Set and achieve goals
- Receive personalized AI coaching and guidance
- Connect with accountability partners
- Access curated educational content
- Track progress and earn achievements
2.2 AI-Powered Features
Win Mode uses artificial intelligence (including but not limited to OpenAI, Groq, and Anthropic Claude) to:
- Analyze your habits and patterns
- Provide personalized recommendations
- Predict potential roadblocks
- Generate motivational support
- Create customized daily action plans
Important: AI recommendations are guidance only and should not be considered professional advice. See Section 4 for our full disclaimer.
2.3 Service Availability
We strive to provide continuous access to Win Mode, but we do not guarantee:
- Uninterrupted or error-free service
- That the App will be available at all times
- That all features will work on all devices or operating systems
- That data will never be lost (though we implement robust backup systems)
We reserve the right to:
- Modify, suspend, or discontinue any part of the Services
- Perform maintenance, updates, or upgrades
- Limit certain features or restrict access for technical or security reasons
2.4 Geographic Restrictions
Win Mode is available globally through the Apple App Store and Google Play Store, subject to:
- Platform availability in your region
- Local laws and regulations
- Export control laws
We reserve the right to restrict access in certain jurisdictions.
3. User Accounts
3.1 Account Creation
To use Win Mode, you must:
- Create an account using Sign in with Apple or Sign in with Google
- Provide accurate, current, and complete information
- Be at least 9 years old (or meet minimum age requirements in your jurisdiction)
- Have permission from a parent/guardian if under 18
3.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access or security breach
We are not liable for any loss or damage arising from your failure to protect your account.
3.3 Account Ownership
You may not:
- Transfer, sell, or share your account with others
- Create multiple accounts for yourself
- Use another person’s account without permission
- Impersonate any person or entity
3.4 Account Information
You agree to:
- Provide accurate information when creating your account
- Update your information if it changes
- Not provide false, misleading, or fraudulent information
We reserve the right to suspend or terminate accounts with false or misleading information.
4. Important Disclaimers and Limitations
4.1 NOT MEDICAL OR PROFESSIONAL ADVICE
CRITICAL DISCLAIMER:
WIN MODE IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL, PSYCHOLOGICAL, PSYCHIATRIC, OR THERAPEUTIC ADVICE, DIAGNOSIS, OR TREATMENT.
The App provides:
- General habit-building guidance
- Motivational support
- Goal-tracking tools
- Educational content
The App does NOT provide:
- Medical diagnosis or treatment
- Mental health therapy or counseling
- Professional psychological services
- Crisis intervention services
If you are experiencing a mental health emergency, suicidal thoughts, or are in crisis:
- Call emergency services immediately (112 in EU, 988 in US for Suicide & Crisis Lifeline)
- Contact a mental health professional
- Do not rely on Win Mode for emergency support
4.2 Consult Healthcare Professionals
You should always:
- Consult qualified healthcare professionals for medical concerns
- Seek professional help for mental health issues
- Not disregard professional medical advice based on information from Win Mode
- Inform your healthcare provider about any wellness programs you’re following
4.3 No Guarantee of Results
We do not guarantee that using Win Mode will:
- Result in specific outcomes or achievements
- Cure or treat any medical or psychological condition
- Eliminate anxiety, depression, or other mental health issues
- Replace the need for professional treatment
Results vary by individual. Success depends on many factors beyond the App’s control.
4.4 AI Limitations
AI-generated content may:
- Contain errors or inaccuracies
- Not be suitable for your specific situation
- Misunderstand context or nuance
- Provide generic rather than personalized advice
You acknowledge that AI has limitations and should use your own judgment when following AI recommendations.
4.5 Educational Content Disclaimer
Content provided in Win Mode (articles, videos, podcasts):
- Is for informational purposes only
- Is not professional advice
- May be provided by third parties
- Should be independently verified
We do not endorse or guarantee the accuracy of third-party content.
5. Subscriptions and Payments
5.1 Subscription Plans
Win Mode offers subscription-based access to premium features. Subscription details:
- Pricing and plan options are displayed in the App
- Prices may vary by region and currency
- Payment is processed through Apple App Store, Google Play Store, or RevenueCat
- All charges are billed through your Apple or Google account
5.2 Free Trial
We may offer a free trial period for new subscribers:
- Trial duration is specified at sign-up
- You will not be charged during the trial period
- You can cancel anytime during the trial to avoid charges
- If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged
5.3 Automatic Renewal
Your subscription automatically renews unless:
- You cancel at least 24 hours before the current period ends
- Your payment method is declined
- We terminate your subscription
To prevent renewal:
- iOS: Settings > [Your Name] > Subscriptions > Win Mode > Cancel Subscription
- Android: Google Play Store > Account > Payments & Subscriptions > Subscriptions > Win Mode > Cancel
5.4 Payment
By subscribing, you:
- Authorize Apple or Google to charge your payment method
- Agree to pay all subscription fees
- Acknowledge that prices may change with notice
- Are responsible for any taxes or additional charges
Payment is processed by:
- Apple Inc. (for iOS users)
- Google LLC (for Android users)
- RevenueCat (as subscription infrastructure provider)
We do not directly process or store your payment information.
5.5 Refund Policy
Refunds are subject to Apple’s and Google’s refund policies:
- We do not control refund decisions for App Store or Google Play purchases
- Refund requests must be submitted to Apple or Google directly
- Refunds are granted at Apple’s or Google’s sole discretion
To request a refund:

- Android: Google Play Store > Account > Order History
We may provide discretionary refunds on a case-by-case basis for exceptional circumstances. Contact support@winmode.io to request a discretionary refund.
5.6 Price Changes
We reserve the right to change subscription prices at any time. We will:
- Notify you of price changes in advance
- Allow you to accept the new price or cancel your subscription
- Apply the new price at your next renewal after notification
5.7 Cancellation
You may cancel your subscription at any time. Upon cancellation:
- You will retain access until the end of your current billing period
- You will not be charged for subsequent periods
- You will lose access to premium features when the subscription expires
- Your data will be retained according to our Privacy Policy
5.8 Promotional Offers
We may offer promotional pricing, discounts, or special offers:
- Promotional terms are specified at the time of offer
- Offers may have eligibility requirements
- Offers may be limited in duration or quantity
- We reserve the right to modify or cancel promotions
5.9 Taxes
Subscription prices may not include applicable taxes. You are responsible for:
- Sales tax, VAT, GST, or other taxes required in your jurisdiction
- Any additional charges imposed by Apple or Google
6. User Conduct and Prohibited Activities
6.1 Acceptable Use
You agree to use Win Mode only for lawful purposes and in accordance with these Terms. You will:
- Respect other users’ privacy and rights
- Provide accurate information
- Use the App in a manner consistent with its intended purpose
- Comply with all applicable laws and regulations
6.2 Prohibited Activities
You may NOT:
Technical Misuse:
- Reverse engineer, decompile, or disassemble the App
- Attempt to gain unauthorized access to our systems
- Use automated systems (bots, scrapers) to access the App
- Interfere with or disrupt the App’s functionality
- Introduce viruses, malware, or harmful code
- Circumvent security features or restrictions
- Use the App on rooted or jailbroken devices (we reserve the right to restrict access)
Content Violations:
- Post or share illegal, harmful, or offensive content
- Upload content that infringes intellectual property rights
- Share content containing hate speech, harassment, or discrimination
- Distribute sexually explicit or inappropriate content
- Post spam, advertisements, or promotional material
- Share misleading or fraudulent information
Account Abuse:
- Create multiple accounts to abuse features or promotions
- Share, sell, or transfer your account
- Impersonate others or misrepresent your identity
- Use fake information to create accounts
Community Misconduct:
- Harass, bully, or threaten other users
- Stalk or invade others’ privacy
- Engage in discriminatory behavior
- Exploit or manipulate other users
- Engage in any form of abuse toward accountability partners
Commercial Misuse:
- Use the App for commercial purposes without authorization
- Resell access to the App
- Use the App to promote competing services
- Extract data for commercial purposes
6.3 User-Generated Content
When you create content in Win Mode (goals, habit descriptions, messages):
- You retain ownership of your content
- You grant us a license to use your content to provide the Services (see Section 8)
- You are responsible for the content you create
- You must not violate others’ rights or applicable laws
6.4 Community Guidelines
When using community features (accountability partners):
- Be respectful and supportive
- Protect other users’ privacy
- Do not share personal contact information publicly
- Report inappropriate behavior to support@winmode.io
- Remember that Win Mode is not a crisis or emergency service
6.5 Consequences of Violations
If you violate these Terms, we may:
- Issue a warning
- Temporarily suspend your account
- Permanently terminate your account
- Remove or restrict access to content
- Report illegal activities to authorities
- Take legal action if necessary
Termination for violations does not entitle you to a refund.
7. Intellectual Property Rights
7.1 Our Intellectual Property
Win Mode and all content, features, and functionality are owned by ArchitecturePLUS SRL and protected by:
- Copyright laws
- Trademark laws
- Patent laws (where applicable)
- Trade secret laws
- International intellectual property treaties
This includes:
- The Win Mode name, logo, and branding
- The App’s design, interface, and user experience
- Software code and algorithms
- AI models and training data (to the extent we own them)
- Graphics, images, and visual elements
- Text, articles, and written content we create
- Audio and video content we create
7.2 License to Use
We grant you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install the App on your personal device
- Access and use the App for your personal, non-commercial use
- Access content within the App for personal learning and growth
You may NOT:
- Modify, copy, or create derivative works of the App
- Distribute, sell, or sublicense the App
- Remove copyright or proprietary notices
- Use our trademarks without written permission
- Frame or mirror any part of the Services
7.3 Third-Party Content
The App includes content from third parties (articles, videos, podcasts):
- Third-party content is owned by the respective creators
- We display this content under license or fair use
- You must respect third-party intellectual property rights
- Use of third-party content is subject to their terms
7.4 Feedback
If you provide feedback, suggestions, or ideas about Win Mode:
- We may use your feedback without obligation or compensation
- You grant us a perpetual, worldwide, royalty-free license to use feedback
- Feedback does not create any confidential relationship
- We are not obligated to implement any feedback
7.5 DMCA / Copyright Complaints
If you believe content in Win Mode infringes your copyright:

8. User Content and Data
8.1 Your Content
You retain ownership of content you create in Win Mode:
- Goals and habits you set
- Messages to AI coaching features
- Progress notes and reflections
- Community interactions
8.2 License You Grant Us
By using Win Mode, you grant us a worldwide, non-exclusive, royalty-free license to:
- Store and process your content to provide the Services
- Use your content to train and improve our AI features (in anonymized form)
- Display your username and streak to other users (when you choose to share)
- Use anonymized, aggregated data for analytics and research
This license:
- Exists only while you use the App
- Terminates when you delete your account (except for archived data)
- Does not allow us to sell your personal content
- Permits us to use anonymized data indefinitely
8.3 Content Monitoring
We reserve the right, but have no obligation, to:
- Monitor user-generated content
- Remove content that violates these Terms
- Investigate reported violations
- Cooperate with law enforcement
We do not pre-screen content and are not responsible for user-generated content.
8.4 Data Processing
Your data is processed according to our Privacy Policy. By using Win Mode, you consent to:
- Data processing as described in the Privacy Policy
- Use of AI services (OpenAI, Groq, Anthropic) to process your inputs
- International data transfers as necessary for the Services
8.5 Data Backup
While we implement backup systems:
- You are responsible for maintaining your own backups
- We are not liable for data loss
- We do not guarantee data recovery
We strongly recommend keeping records of important goals or insights separately.
9. Third-Party Services and Links
9.1 Third-Party Services
Win Mode integrates with third-party services:
- Apple and Google (authentication, payments)
- Firebase (infrastructure, analytics)
- Mixpanel (analytics)
- OpenAI, Groq, Anthropic (AI services)
- RevenueCat (subscription management)
These services have their own terms and privacy policies. We are not responsible for third-party services.
9.2 Third-Party Content
Win Mode links to and displays third-party content:
- Articles, videos, and podcasts
- External websites
- Educational resources
We do not:
- Control third-party content
- Endorse third-party content
- Guarantee accuracy of third-party content
- Take responsibility for third-party websites
9.3 No Warranties for Third Parties
We make no warranties or representations about:
- The quality of third-party services
- The accuracy of third-party content
- The security of third-party platforms
- Your interactions with third parties
Access third-party services and content at your own risk.
10. Limitation of Liability
10.1 Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WIN MODE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND.
We disclaim all warranties, including:
- Implied warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy or reliability of content
- Uninterrupted or error-free service
- Security or freedom from viruses
WE DO NOT WARRANT THAT:
- The App will meet your requirements
- Results will be achieved
- Errors will be corrected
- The App will be compatible with your device
10.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:
- Loss of profits, revenue, or data
- Loss of business opportunity
- Personal injury or property damage
- Emotional distress
- Cost of substitute services
- Any damages arising from use or inability to use the App
EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
10.3 Maximum Liability
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED:
THE AMOUNT YOU PAID TO US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR €100 (ONE HUNDRED EUROS), WHICHEVER IS GREATER.
10.4 Essential Purpose
Some jurisdictions do not allow limitations on warranties or liability. If these laws apply to you, some of the above limitations may not apply. However, these limitations apply to the maximum extent permitted by law.
10.5 User Responsibility
You acknowledge that:
- You use Win Mode at your own risk
- You are responsible for your own decisions and actions
- We cannot control how you use the App
- We are not responsible for harm resulting from your misuse
11. Indemnification
11.1 Your Indemnification Obligation
You agree to indemnify, defend, and hold harmless ArchitecturePLUS SRL, its officers, directors, employees, agents, licensors, and service providers from and against:
Any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising from or related to:
- Your use or misuse of the App
- Your violation of these Terms
- Your violation of any laws or regulations
- Your violation of third-party rights
- Content you create or share
- Your interactions with other users
- Any damage you cause to our systems or reputation
11.2 Defense of Claims
If we face a claim for which you must indemnify us:
- We will notify you promptly (delay does not waive your obligation)
- We may control the defense and settlement
- You will cooperate with our defense
- You may not settle without our written consent
11.3 Exceptions
You are not required to indemnify us for claims arising from:
- Our gross negligence or willful misconduct
- Our breach of these Terms
- Defects in the App that we knew about
12. Dispute Resolution
12.1 Governing Law
These Terms are governed by the laws of Romania, without regard to conflict of law principles.
The United Nations Convention on Contracts for the International Sale of Goods does not apply.
12.2 Jurisdiction
Subject to the arbitration provisions below, you agree to submit to the exclusive jurisdiction of the courts located in Bucharest, Romania for resolution of disputes.
12.3 Informal Resolution
Before filing any formal claim, you agree to:
- Contact us at support@winmode.io describing the dispute
- Provide us 30 days to attempt resolution
- Negotiate in good faith
Many disputes can be resolved quickly through informal communication.
12.4 Arbitration (Optional)
For users in jurisdictions that permit arbitration:
If informal resolution fails, either party may elect binding arbitration:
- Arbitration will be conducted under the rules of a recognized arbitration body
- Arbitration will be in Bucharest, Romania (or mutually agreed location)
- Arbitration will be in English or Romanian
- Each party bears its own costs (unless law requires otherwise)
- Arbitration decision is final and binding
YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND CLASS ACTION.
12.5 Exceptions to Arbitration
The following disputes are not subject to arbitration:
- Intellectual property disputes
- Small claims court matters (below jurisdictional limit)
- Injunctive or equitable relief
- Emergency legal relief
12.6 EU Users – Consumer Rights
If you are a consumer in the EU:
- You may have additional rights under EU consumer protection laws
- These Terms do not limit your mandatory legal rights
- You may bring proceedings in your country of residence
- You may access the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr
12.7 Class Action Waiver
YOU AGREE THAT DISPUTES WILL BE RESOLVED INDIVIDUALLY, NOT AS A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION.
You waive any right to:
- Participate in a class action lawsuit
- Act as a class representative
- Participate in a consolidated or representative proceeding
This waiver applies to the maximum extent permitted by law.
13. Termination
13.1 Termination by You
You may terminate your account at any time by:
- Deleting your account in the App (Settings > Account > Delete Account)
- Emailing support@winmode.io with “Delete My Account”
- Canceling your subscription (access continues until subscription expires)
13.2 Termination by Us
We may suspend or terminate your account immediately, without notice, if:
- You violate these Terms
- You engage in fraudulent activity
- You abuse or harass other users
- You compromise security or integrity of the App
- Required by law
- We discontinue the App
13.3 Effect of Termination
Upon termination:
- Your right to use the App immediately ceases
- You lose access to your account and data
- Your subscription is cancelled (no refund for remaining time)
- Sections of these Terms that should survive will remain in effect
13.4 Data After Termination
After termination:
- We will delete your personal data according to our Privacy Policy
- We may retain certain data as required by law or for legitimate business purposes
- Anonymized data may be retained indefinitely
- You have 30 days to export your data before deletion (contact support)
13.5 Survival
The following provisions survive termination:
- Intellectual Property Rights (Section 7)
- Limitation of Liability (Section 10)
- Indemnification (Section 11)
- Dispute Resolution (Section 12)
- Any provisions that by their nature should survive
14. General Provisions
14.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and ArchitecturePLUS SRL regarding Win Mode. They supersede all prior:
- Agreements, whether written or oral
- Representations or understandings
- Proposals or negotiations
14.2 Severability
If any provision of these Terms is found to be invalid or unenforceable:
- That provision will be modified to the minimum extent necessary to make it valid
- If it cannot be modified, it will be severed
- All other provisions remain in full force and effect
14.3 No Waiver
Our failure to enforce any provision of these Terms does not constitute:
- A waiver of that provision
- A waiver of our right to enforce it later
- A waiver of any other provision
Any waiver must be in writing and signed by us.
14.4 Assignment
You may not assign or transfer these Terms or your account without our written consent.
We may assign these Terms:
- To any affiliate or subsidiary
- In connection with a merger, acquisition, or sale of assets
- To any successor or acquirer
14.5 Force Majeure
We are not liable for any delay or failure to perform due to circumstances beyond our reasonable control, including:
- Natural disasters
- War, terrorism, or civil unrest
- Government actions or regulations
- Internet or telecommunications failures
- Cyberattacks or security incidents
- Labor disputes
- Supplier failures
14.6 Relationship of Parties
These Terms do not create:
- An employment relationship
- A partnership or joint venture
- An agency relationship
- Any fiduciary duty
You are an independent user of the Services.
14.7 No Third-Party Beneficiaries
These Terms are solely for your benefit and ours. They do not create rights for any third parties.
14.8 Notices
Notices to You: We may provide notices by:
- Posting in the App
- Sending in-app notifications
- Emailing you at your registered email address
- Posting on our website
Notices to Us: Legal notices must be sent to:

- When posted (for in-app or website notices)

14.9 Language
These Terms are written in English. If translated:
- The English version controls in case of conflict
- Translation is for convenience only
- We are not responsible for translation inaccuracies
14.10 Headings
Section headings are for convenience only and do not affect interpretation.
14.11 Interpretation
In these Terms:
- “Including” means “including but not limited to”
- Singular includes plural and vice versa
- “Or” is not exclusive
- “Days” means calendar days unless otherwise specified
14.12 Mobile Platform Terms
Your use of Win Mode is also subject to:
- Apple’s App Store Terms of Service (iOS users)
- Google Play Terms of Service (Android users)
In case of conflict, these Terms govern the relationship between you and us, while platform terms govern your relationship with Apple or Google.
Apple Users: These Terms are between you and ArchitecturePLUS SRL, not Apple. Apple is not responsible for the App or any claims related to it.
Google Users: These Terms are between you and ArchitecturePLUS SRL, not Google. Google is not responsible for the App or any claims related to it.
14.13 Export Controls
You agree to comply with all export control and sanctions laws. You may not use the App if:
- You are located in an embargoed country
- You are on a government restricted party list
- Export controls prohibit your access
14.14 Accessibility
We strive to make Win Mode accessible to users with disabilities. If you encounter accessibility issues, please contact support@winmode.io.

BY USING WIN MODE, YOU ACKNOWLEDGE THAT:
